Terms of service
Effective 28 October 2026
These terms set out the rules for using smsportal.app. By creating an account you accept them. If anything is unclear, write to us before you start.
1. Who provides the service
The service is provided by ITWorks Katarzyna Bańcer, ul. Sikorskiego 9a, 02-864 Warsaw, Poland, tax ID (NIP) 1231178164, REGON 145833271 (“we”).
Contact: support@smsportal.app. We reply on business days.
2. What the service does
smsportal.app turns an Android phone into an SMS gateway. You queue messages in the dashboard (smsportal.app/dashboard), through the API, webhooks, integrations or the MCP server for AI agents. Our server passes them to the app on your phone, and the phone sends them from your SIM card. The app forwards received SMS back to the dashboard, API and webhooks.
We are not a mobile carrier and do not send SMS from our own infrastructure. Your carrier’s network delivers the messages.
3. What you need
- An up-to-date web browser for the dashboard.
- An Android 7.0 or newer phone with an active SIM card and internet access.
- The smsportal app downloaded from smsportal.app, with permission to send and receive SMS.
- An email address to create the account.
4. Account and agreement
The agreement starts when you create an account. The Free plan is free and has no end date. You order a paid plan in the dashboard.
Give true details and keep your password and API keys safe. You are responsible for what is done from your account and with your keys. Revoke any key that may have leaked in the dashboard.
5. Plans and payments
- Free: $0, up to 300 sent SMS a month.
- Pro: $9.99 (39.99 PLN) a month, up to 3,000 sent SMS a month.
- Unlimited: $24.99 (99.99 PLN) a month, no plan limit.
PLN prices include Polish VAT. The limit counts SMS sent in a calendar month (UTC). Received SMS do not count. No plan limits the number of connected phones.
Current plans are on the pricing page (smsportal.app/en/pricing). If the pricing page and these terms differ, the price shown at checkout applies.
A paid plan is paid by card in advance for one month, through Stripe. The subscription renews every month until you cancel it. You can cancel at any time in the dashboard: the plan runs to the end of the paid month, then the account returns to Free. We do not refund a started month, except as described in section 11.
Invoices are available in the dashboard (Account → Payments).
6. Carrier charges
SMS leave from your SIM card, so your carrier bills them under your tariff. We are not responsible for those charges or for blocks your carrier applies. Check your tariff’s terms, especially for high volumes.
7. Acceptable use
By using the service you agree that you will:
- not send spam or marketing messages without the consent the law requires, and respect opt-outs,
- not send unlawful or fraudulent content or impersonate other people or businesses (for example phishing),
- have a legal basis to process the numbers and data of the people you message,
- not try to get around limits, security or the operation of the service, or overload it on purpose.
8. Data in your messages (processing agreement)
Recipient numbers, contacts and message content are your data. You are their controller, and we process them on your behalf (Article 28 GDPR). This section is the data processing agreement.
- We process this data only to provide the service, that is on your instructions given through the dashboard, API, integrations or the app.
- People with access to the data are bound by confidentiality.
- We apply the security measures described in the privacy policy.
- We use the sub-processors listed in the privacy policy. We give 14 days’ notice by email of a change; you may object and end the agreement.
- We help you respond to data subject requests and meet your duties under Articles 32–36 GDPR.
- We tell you about a breach affecting this data without undue delay, and within 72 hours of finding it.
- When you delete the account we delete this data; backups expire as described in the privacy policy.
- We provide the information needed to show compliance with Article 28 GDPR and allow audits at an agreed time.
9. Availability and liability
We work to keep the service running but do not guarantee uninterrupted operation or delivery of every message. Delivery also depends on the phone, its power and internet connection, the SIM card and the carrier network.
We keep maintenance as short as we can. Messages already accepted into the queue go out once the service is back.
Towards businesses we are liable only for damage caused intentionally or by gross negligence, and at most up to the amount paid to us in the last 12 months. Towards consumers we are liable under general law.
10. Complaints
Send complaints to support@smsportal.app. Describe the problem and give your account email. We reply within 14 days.
11. Consumers and withdrawal
If you are a consumer, you may withdraw from a paid plan within 14 days of ordering it, without giving a reason. An email to support@smsportal.app is enough.
By ordering a plan you ask for the service to start at once. If you withdraw, we refund the payment minus the share for the days the plan was active, within 14 days, to the same payment method.
12. Ending the agreement
You can end the agreement at any time: cancel a paid plan and request account deletion in the dashboard (Account → Delete account). We delete the account within 30 days of the request.
We may suspend or delete an account that breaks section 7 or the law, especially for spam and fraud. Otherwise we may end the agreement with 30 days’ notice by email and refund any unused paid period.
13. Changes to these terms
We announce changes by email at least 14 days before they take effect. If you do not agree, you may end the agreement before that date. Changes do not affect a period you have already paid for.
14. Governing law
These terms are governed by Polish law. They do not limit the rights consumers have under the law of their country of residence. Disputes with businesses are settled by the court competent for our registered address.
How we handle personal data is described in the privacy policy (smsportal.app/en/privacy). These terms apply from 28 October 2026. The Polish version (smsportal.app/regulamin) prevails if the two differ.
